Acceptance of Terms
By accessing or using Brokerage IQ (the "Service") at thebrokerageiq.com, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and Brokerage IQ, operated by Joey Dominguez, Licensed California Real Estate Broker, DRE License #02135943, Palm Springs, California.
We reserve the right to update these Terms at any time. Continued use of the Service after any changes constitutes your acceptance of the new Terms.
Description of Service
Brokerage IQ is an AI-powered real estate brokerage management platform that provides:
- Transaction management and milestone tracking for real estate professionals
- AI-assisted compliance guidance for California DRE requirements
- Document processing and analysis powered by AI
- Client portals for buyers, sellers, and agents
- AI chat assistant for real estate questions and guidance
- Knowledge base management and compliance center tools
The Service is currently in seed stage and may be updated, modified, or discontinued at any time with reasonable notice to users.
User Responsibilities
As a user of the Service, you agree to:
- Provide accurate and complete information when creating your account
- Maintain the confidentiality of your login credentials
- Use the Service only for lawful purposes and in compliance with California DRE regulations
- Not share access credentials with unauthorized third parties
- Not attempt to reverse-engineer, decompile, or interfere with the Service
- Not upload malicious code, spam, or content that infringes third-party rights
- Independently verify all transaction data, compliance deadlines, and legal requirements
- Notify us promptly of any unauthorized use of your account
You are solely responsible for all activity that occurs under your account. Real estate professionals using the Service remain responsible for compliance with all applicable laws and DRE regulations regardless of AI-generated guidance received.

AI-generated content is informational only and does not constitute legal, financial, or professional advice.
The AI Assistant, compliance guidance, document analysis, and all other AI-generated outputs provided through Brokerage IQ are intended solely as informational tools to assist real estate professionals. They do not constitute:
- Legal advice or legal counsel
- Financial or investment advice
- A substitute for consulting a licensed attorney, CPA, or other qualified professional
- Guaranteed compliance with California DRE requirements or any other regulatory body
AI systems can make errors, produce outdated information, or generate outputs that are incorrect in specific contexts. You must independently verify all AI-generated content before relying on it for any transaction, legal matter, or compliance decision.

Intellectual Property

You retain ownership of content and data you upload to the Service. By uploading content, you grant us a limited license to process and store that content for the purpose of providing the Service to you.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, BROKERAGE IQ, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages arising from reliance on AI-generated content or guidance
- Errors, omissions, or inaccuracies in transaction data or compliance guidance
- Service interruptions, downtime, or data loss
- Actions or omissions of third-party service providers
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO USE THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
Some jurisdictions do not allow exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
Any disputes arising from these Terms or use of the Service shall be subject to the exclusive jurisdiction of the courts located in Riverside County, California. You consent to personal jurisdiction in such courts.
Any cause of action related to use of the Service must be commenced within one (1) year after the cause of action accrues.
Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with reasonable notice where practicable. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.
